These Terms of Service ("Terms") constitute a binding agreement between you ("Customer", "Client", "you") and Tracefox Inc. ("Tracefox", "we", "us") regarding your access to and use of Tracefox, including our web application, Chrome extension recorder, scheduled checkout test runs, background scanning jobs, alerts, exports, and reports (collectively, the "Service"). By creating an account, starting a trial, or using the Service, you agree to these Terms.

1. Definitions

  • "Monitored Website": any URL, domain, or property you add to the Service for site monitoring (the scan-and-diff pipeline that tracks scripts, cookies, consent banners, and similar surfaces).
  • "Checkout Test" / "Test": a recorded sequence of steps (clicks, form fills, navigations, waits) that Tracefox replays in a headless browser to verify your checkout flow. You define the steps either by recording in our Chrome extension or by configuring them manually.
  • "Test Run": a single execution of a Checkout Test by our background workers, producing screenshots, video, and per-step pass/fail results.
  • "Test Data": the input values you configure for Test runs (e.g. name, email, shipping address, coupon codes, test card numbers). See Section 4 for important restrictions on submitting real payment cards.
  • "Scan": an automated session where Tracefox loads pages using a headless browser and records observations about the site (scripts, cookies, third-party domains, policy text hashes, etc.). Used by the site monitoring pillar.
  • "Snapshots": scan outputs including metadata, hashes, evidence and diffs.
  • "Report": an export generated by the Service (e.g., PDF summaries, timelines, diffs, test-run histories).
  • "Potential Risk": a heuristic label indicating a change that may require review, depending on implementation and jurisdiction.

2. Service Description (Evidence, Not Legal Advice)

Tracefox provides two product pillars under one Service:

  • Automated checkout testing (primary). We execute the Checkout Tests you configure on the schedule you choose (manual, hourly, daily, or weekly), in real headless Chromium across the viewports you select (desktop, mobile, tablet). When a step fails, we send alerts via email and Slack, attach screenshots and video, and surface the failure in your dashboard. We do NOT place real orders; Test Runs are intended to verify checkout reachability and step-level behavior using the Test Data you provide.
  • Site monitoring (bonus, every plan). We continuously scan Monitored Websites and detect meaningful changes related to tracking and privacy surfaces (scripts, third-party domains, cookies, consent banner text). This is the same evidence-and-change-timeline functionality Tracefox has always provided, now included on every paid plan.

Important: Tracefox is not a cookie banner / CMP and does not block, prevent, or enforce cookies. Tracefox does not provide legal advice, and does not determine or certify that any website is "compliant" or "non-compliant". Reports and labels (including "Potential Risk") are informational only. Test Runs verify what a scripted browser session observes; a Test Run passing is evidence that the scripted steps completed, not a guarantee that all real customers can complete checkout.

3. Account, Access, and Security

  • Account security: You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
  • Accurate information: You must provide accurate account and billing information and keep it updated.
  • Team access: If you invite or allow other users to access the Service under your account, you are responsible for their actions.

4. Customer Responsibilities, Authorization, and Test Data

By using the Service you represent, warrant, and agree that:

  • Authorization: You own, operate, or are authorized to scan and test each Monitored Website and Checkout Test target, including all URLs you add (such as product pages, cart pages, checkout pages, and policy URLs).
  • Scope: You understand that scans and Test Runs may follow redirects, load embedded third-party resources, interact with form fields, submit forms, and otherwise drive the page as a real browser would. You consent to that interaction with your own Monitored Websites.
  • Compliance with rules: You will comply with applicable laws, contractual obligations, and the website owner's policies and instructions, including the terms of any third-party platform you operate on (Shopify, WooCommerce, BigCommerce, Magento, payment processors, etc.).
  • No live payment cards: You will only configure Test Data using payment methods designated as test cards by the relevant processor (e.g. Stripe test card numbers such as 4242 4242 4242 4242, the PayPal sandbox environment, etc.). You will NOT enter real, live payment card numbers into Test Data. Real-card processing is your responsibility and outside the scope of the Service. Tracefox is not liable for charges incurred from a real card you knowingly or accidentally configured into a Test.
  • Test Data sensitivity: Test Data you configure (names, emails, addresses, phone numbers) is replayed at the Test Run schedule. If you configure real personal data belonging to identifiable individuals, you are responsible for having a lawful basis to process it.
  • No third-party order placement: You will not configure Tests that submit real orders for goods or services you do not intend to receive. The Service is for verifying checkout reachability, not for placing live commerce orders.

By adding a Monitored Website or configuring a Checkout Test, you authorize Tracefox and its background workers (operating via headless browsers and automated network observation) to access, crawl, replay, and download content from the targeted URLs at configured intervals. You acknowledge scans and Test Runs may generate network traffic to your websites and to any third-party resources they load.

5. Free Tools

Tracefox offers free website analysis tools (e.g., cookie scanner, SEO checker, security headers checker) that do not require an account. By using these tools:

  • You represent that you have authorization to scan the URL you submit.
  • Results are provided "as is" for informational purposes only and do not constitute legal, security, or compliance advice.
  • Usage is subject to rate limits. Automated or bulk usage is prohibited.

6. Acceptable Use (No Abuse)

You may not use the Service to:

  • Scan targets you do not control or lack permission to scan.
  • Attempt to access internal networks, private endpoints, or non-public infrastructure (including via SSRF or similar techniques).
  • Perform denial-of-service activity, high-volume scraping outside normal product usage, or disrupt others' systems.
  • Reverse engineer, decompile, or attempt to discover source code (except to the extent permitted by law).
  • Resell the Service or use it to build a competing product without our written consent.

7. Data, Snapshots, Test Artifacts, and Confidentiality

The Service may store:

  • Snapshot metadata, hashes, diffs, and Reports for your Monitored Websites.
  • Checkout Test definitions (steps, success conditions, Test Data), Test Run results, per-step screenshots, full-session video recordings, and error logs.
  • Account, billing, and audit data (login events, IP addresses, consent timestamps).

Some Monitored Websites and Test Runs may capture confidential or proprietary materials, including images of pages mid-checkout. You are responsible for ensuring you have the right to allow us to process such data, particularly when your Tests interact with third-party payment processors, customer-account flows, or staging environments containing customer-like data.

We will use your data to provide and improve the Service, to prevent abuse, and to comply with legal obligations. We will not sell your Customer data. Test Run media (screenshots, videos) is retained per your plan's history-retention window and is automatically deleted after that window via our retention job. 8. Intellectual Property

Tracefox IP: We retain all rights, title, and interest in the Service, including our scanning engine, code, design, and analytics algorithms.

Customer Data: You retain ownership of Customer Data you submit and the outputs we generate for you (Snapshots and Reports) to the extent you have rights in them. You grant Tracefox a limited license to host, process, transmit, and display Customer Data solely to provide the Service.

9. Trials, Subscriptions, Billing, and Taxes

  • Trial: If you start a free trial, no charges are due at sign-up. Unless you cancel before the trial ends, your subscription will automatically begin and you will be billed when the trial ends.
  • Billing provider: We use Stripe to process payments and manage subscriptions.
  • Plan limits: Your plan may limit the number of websites and scan frequency. We may enforce limits server-side.
  • Taxes: Prices may exclude taxes and you are responsible for applicable taxes unless otherwise stated.
  • No refunds: Fees are non-refundable except where required by law.

10. Availability, Changes, and Support

The Service may be unavailable at times (including due to maintenance, third-party outages, or network issues). Scans may fail or be incomplete due to website restrictions, rate limiting, bot detection, geo restrictions, or changes in page behavior. We may change or discontinue features over time.

11. Suspension and Termination

We may suspend or terminate your account (or disable scanning for specific targets) if we reasonably believe you are violating these Terms, creating security risk, abusing the Service, or exposing Tracefox to liability. You may stop using the Service at any time and may cancel your subscription via the billing portal.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACEFOX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TRACEFOX DOES NOT GUARANTEE THAT SCANS WILL IDENTIFY EVERY TRACKER, COOKIE, OR THIRD-PARTY REQUEST, OR THAT REPORTS WILL BE COMPLETE OR ERROR-FREE.

TRACEFOX DOES NOT GUARANTEE THAT A PASSING CHECKOUT TEST RUN MEANS ALL REAL CUSTOMERS CAN COMPLETE CHECKOUT, OR THAT A FAILING TEST RUN ACCURATELY REPRESENTS A CUSTOMER-FACING ISSUE. TEST RUNS ARE AUTOMATED SCRIPTED SESSIONS AND MAY DIVERGE FROM HUMAN BEHAVIOR, REAL DEVICES, OR REAL NETWORK CONDITIONS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACEFOX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACEFOX'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO TRACEFOX FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Tracefox from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service in violation of these Terms, (b) your Monitored Websites, or (c) any claim that scans performed at your direction violated the rights of a third party or applicable laws.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. For significant changes, we may also notify you via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
